If you are a DOT safety-sensitive worker who has violated drug and alcohol regulations, DOT requires you to complete the SAP process before returning to duty.

FAQ: DOT Return-to-Duty Process

  • Employers must remove the employee from safety-sensitive functions after verified positive drug results, certain alcohol results, or other violations and must not return them until the RTD process is successfully completed.

  • The RTD process is the required pathway a DOT-regulated safety-sensitive employee must complete after a DOT drug/alcohol violation before they can return to safety-sensitive duties.

  • You cannot perform safety-sensitive duties until you successfully complete the RTD process. Your employer may decide whether you can work in a non-safety-sensitive role (that’s an employer decision).

  • If the employer permits the employee to return, the employee must take an RTD test after the SAP determines successful compliance. The employee must have a negative drug test and/or an alcohol test result below 0.02 before resuming safety-sensitive duties.

  • Yes. The follow-up testing requirement follows the employee, and a subsequent employer is responsible for ensuring completion during the follow-up period.
